Calquity Technologies Private Limited, including its subsidiaries and affiliates (hereinafter referred to through its brand names "CQNow" and "CalQuity" or "Company" or "we" or "us"), a company incorporated under the Companies Act, 2013, having its registered office at 6 Garstin Place, Suite 501, Kolkata-700001, provides access to its websites, including but not limited to https://www.calquity.com/, https://now.calquity.com/, https://www.cqnow.in/ ("Website"), and all services provided thereunder, subject to these terms and conditions. By accessing or using our Website and services, you expressly acknowledge and agree to be bound by these terms and conditions, our Privacy Policy, and Refund Policy. If you disagree with any part of these terms, you must not use our Website or services.
You represent and warrant that you are at least 18 years of age and possess the legal capacity to enter into these terms and use the Website in accordance with all applicable laws. You further represent that you are not barred from receiving services under the laws of India or other applicable jurisdictions. The Company reserves the right to terminate or suspend your access to the Website and services immediately without notice if we reasonably believe that you have violated any provision of these terms or applicable laws.
The services provided through our Website are strictly for personal use only. You are expressly prohibited from sharing, distributing, or using any content or data obtained through our services for commercial purposes. Each user is permitted to maintain only one account, and creating multiple accounts is strictly prohibited. Any attempt to create multiple accounts or share account access may result in immediate termination of all associated accounts without refund.
While we strive to maintain service availability, we do not guarantee uninterrupted access to our services. We target a 99.95% uptime but shall not be liable for any service interruptions or unavailability due to factors beyond our reasonable control, including but not limited to technical failures, system maintenance, network issues, acts of nature, or force majeure events.
All intellectual property rights in the Website and its contents, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, are owned by or licensed to us and are protected by Indian and international intellectual property laws. Refund and Cancellation Policy
Our subscription fees are non-refundable once charged, and subscriptions will automatically renew according to your chosen plan until canceled. By subscribing to our services, you authorize us to automatically charge the applicable subscription fees at the beginning of each billing cycle through our payment gateway partner, Razorpay, using your designated payment method. We reserve the right to modify our subscription fees at any time for any reason. In the event of a price change, we will provide you with prior notice through email or notification on our Website. Upon receiving such notice, you will have the option to either continue your subscription at the new price or cancel your subscription before the price change takes effect. If you do not cancel your subscription before the price change takes effect, you will be deemed to have rejected the new pricing terms and your subscription will be terminated with a pro-rata refund issued in case of any unused portion in your subscription.
You may cancel your subscription at any time through your account dashboard or by contacting support@calquity.com. Cancellation requests must be submitted at least two (2) working days before the renewal date to prevent charges for the next billing cycle. Upon cancellation, you will lose access to the services and no refunds will be provided for any unused portion of the current billing period.
When upgrading or downgrading your subscription plan you will be charged the entire amount payable for the new subscription, and a refund for the unused portion of your current subscription will be refunded to you on a pro-rata basis and will be processed within seven to ten (7-10) working days through our payment gateway partner, Razorpay, subject to their processing times and banking procedures.
No refunds will be provided for partial usage, unused services, or early cancellation of subscriptions. However, refunds may be considered in exceptional circumstances, including but not limited to technical failures preventing service delivery, unauthorized charges, service unavailability due to our fault, or as required by applicable law. When applicable, refunds will be processed within seven to ten (7-10) working days through our payment gateway partner, Razorpay, subject to their processing times and banking procedures. Examples of exceptional circumstances include prolonged service downtime due to technical faults or double billing errors.
For any disputes related to refunds or cancellations, you must contact our support team at support@calquity.com with relevant transaction details and supporting documentation. We will attempt our best to acknowledge your request within 48 hours and work to resolve your concerns promptly. If you are dissatisfied with the resolution provided by our support team, you may escalate the matter to our Grievance Officer for further review.
These Terms and Conditions, Privacy Policy, and Refund Policy may be updated from time to time at our sole discretion. Any changes will be effective immediately upon posting the updated versions on our Website. Your continued use of our Website and services after any modifications indicates your acceptance of the updated terms. These terms shall be governed by and construed in accordance with the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal.
